ANALISIS YURIDIS PUTUSAN NO. 11/PID.SUS/2014/PN.TNG MENGENAI TINDAK PIDANA PEMBUNUHAN ANAK OLEH IBU KANDUNGNYA YANG MASIH DI BAWAH UMUR

Abstract

This study examines the case of the murder of a minor by her biological mother, who was also legally classified as a child, as reflected in the Tangerang District Court Decision No. 11/Pid.Sus-Anak/2014/PN.TNG. The research aims to analyze the judge’s considerations in rendering the verdict and to identify the underlying factors that led to the criminal act. A normative juridical method with a qualitative approach was employed, using secondary data sources. The findings indicate that the defendant was legally proven to have committed the murder of her newborn child. However, the panel of judges decided to release the defendant, taking into account her status as a minor and the need to protect her future. The contributing factors to the incident include a lack of parental supervision, negative environmental influences, and limited understanding of religious, moral, and legal values.
